Agency Workers Regulations

Despite reports to the contrary, the Government has confirmed that it has no plans to amend or suspend the implementation of the Agency Workers Regulations 2010, which come into force on 1 October 2011.

The Regulations will provide agency workers with the same basic rights as permanent employees after 12 weeks on the job.

After the initial 12 week period, agency workers must be provided with the same equal pay and working conditions as other staff members, and will also be entitled to other benefits afforded to the rest of the workforce.

Furthermore, employers will have to ensure that agency workers have access to facilities such as the canteen and childcare facilities and access to job vacancies within the company from their first day.

If employers do not comply with the Regulations they could find themselves the subject of employment tribunal claims.
