Nevertheless, surprisingly less than a third of adults in the UK actually make a Will, leaving their families to suffer uncertainty, delay, possible conflict and potential tax and costs implications. In essence, a Will allows you to decide how your estate is distributed.
People are often surprised by what happens if you do not make a Will.
For instance, under the Intestacy rules your spouse may not receive everything when you die and if you are unmarried but living together, your partner may not receive anything at all.
Here are a few more key facts worth noting if you haven’t made a Will:
- The choice of who administers your estate is taken away from you.
- No-one is appointed to act as a guardian for infant children – you should choose who you want to look after your children otherwise they could be placed with family or friends who would not be your choice of guardian.
- Children inherit at 18 – which may not be appropriate in every case.
- No provision is made for friends, relatives and charities to receive any money from your estate.
- Inheritance Tax could be paid where it is not necessary or could have been significantly reduced.
