More businesses and employees are attempting to resolve disputes at work without resorting to employment tribunals.
The latest annual report from the Advisory, Conciliation and Arbitration Service (ACAS) has found that demand for its “Pre-Claim Conciliation” early dispute resolution service rose by over a third in the last 12 months.
Pre-Claim Conciliation was launched in April 2009 with the aim of resolving workplace issues before they result in a costly and stressful employment tribunal claim.
In 2011/12 ACAS dealt with 23,777 cases, 6000 more than the previous year and the proportion of cases settled without a tribunal went up by 4% to 78%. The most common issue encountered by the early resolution service was unfair dismissal.
New Government plans, which are due to come into effect in 2014, will make it compulsory for everyone to contact ACAS before an employment tribunal claim can be made.
