Unregistered property? Consider voluntary registration.
Although a great deal of property is now registered at the Land Registry, not all of it is. Registration does have considerable benefits - for example, registration involves the checking of the title so there is a lower risk of problems at a later date.
The Land Registry is responsible for maintaining an accurate record of all properties and land in the country and it is now compulsory to register any unregistered property if it is involved in any transaction - such as a sale or a mortgage.
If your property is not registered we would recommend that you consider applying to register it voluntarily.
The benefits of registration are:
• You will be registered at the Land Registry as being the owner of the property and the title will have been checked.
• The register would set out all rights and obligations affecting your property and the Land Registry title plan will show the extent of the property much more clearly and accurately than the old deeds.
• Registration protects you against claims on your property / land by someone trying to make a claim for possession.
• Registration would also bring all your documentation up to date and provide you with the security that your property is adequately protected in the event of your deeds being lost or destroyed.
Voluntary registration attracts a reduced Land Registry fee, which is based on the value of your property.
