Liar, ITV’s new 6-part drama, is gripping the nation. People are already reaching their own conclusions as to whether Laura, played by the actress Joanne Froggatt (better known for her role as Anna Bates in Downton Abbey), is telling the truth when she accuses surgeon Andrew Earlham of raping her.
For most of us, this is a highly watchable drama. As we flip between who we believe, our perceptions are changed over time by the sophisticated script and device plots.
It is no surprise that some people have formed an opinion already, but this has worrying implications in real-life criminal proceedings. As recent research has demonstrated, half of all jurors are likely to reach a guilty verdict before even going to deliberate with the rest of the jury.
We know that people are, on occasion, willing to change their minds, just as you might when the plot unfolds. However, first impressions count, and dealing with a false but convincing allegation is a difficult thing to do effectively.
It is vital therefore that a strong case is advanced from the start, laying a solid foundation for a successful defence.
What we do
For our clients and their families, facing a serious criminal accusation, be it rape, sexual crime, violence or harassment, can be a horrendous and life-changing experience. So, what is our role and how do we defend such cases?
Proactive from the start
We contact the Police and the Crown Prosecution Service (CPS) straight away and urgently request the initial details of the case against you. This helps us to quickly assess the strength and weaknesses of the case and to advise you on effective case strategy.
Quite often the CPS will rely solely on the competing versions of events. It can feel as if it is simply one word against another and often it is unless you seek further evidence.
It is a proactive approach to case preparation which makes a difference. We always ensure that:
- All relevant witnesses are traced and spoken to
- Any CCTV evidence is secured early
- Forensic evidence is analysed and, if appropriate, experts are instructed
- Background checks are completed
- Details of previous false allegations and other relevant history are pursued
- Psychiatric or other issues of the complainant’s are explored
