The Government today announced that the Bribery Act 2010 will now to come into force on 1st July 2011.
The Ministry of Justice today finally published its long-awaited guidance on the Act for businesses.
Claims that corporate hospitality would be outlawed by the Act appear to be unfounded, with the Ministry of Justice confirming that, provided any such corporate hospitality serves a legitimate business interest and is not disproportionate, it would not be caught by the Act.
Nevertheless, it will still be essential for all businesses to implement anti-bribery procedures that satisfy the criteria laid down in the guidelines in order to defend any allegation that they might have committed the new criminal offence of failing to prevent bribery.
We strongly recommend that you review your procedures now to prevent your business being caught unawares by the new regime in July.
