The commercial dispute team at Blaser Mills Law has an in-depth understanding of business as well as the law. We will always put your commercial interests first and foremost when we work on your behalf to resolve a dispute.

Business-focused advice and in-depth legal knowledge

As commercial dispute solicitors and litigation lawyers, we can advise you on the best way to approach business disagreements. Our team is extremely business-focused. We will always look at the bigger picture to ensure that your commercial objectives, business security and reputation are also taken into account, as well as the merits of your legal case.

We will assess the situation thoroughly and discuss the options for resolution with you. There are a number of ways to resolve a commercial dispute and we always make sure we explain these clearly to you, along with the risks or advantages associated with each.

It is our policy to be honest and direct. If we believe that your case is not particularly strong, we will tell you very early on so that you can decide how to proceed, for example, by way of a negotiated settlement.

Solutions to commercial disputes

There are several ways to resolve a commercial dispute. Our team has the in-depth knowledge to know which option will be the most beneficial to a business and we will give you our opinion and discuss it with you, to ensure you understand our recommendations.

It is often the case that once commercial litigation solicitors become involved in a dispute, the parties involved are more open to negotiation. We would draft a solicitor’s letter on your behalf, setting out your position and opening negotiations.

A major benefit of negotiation is that a resolution can be agreed upon quickly and everyone involved can focus on moving forward. It will involve some compromise on behalf of one or both parties, but very often that is far preferable to protracted legal proceedings.

Alternative Dispute Resolution

Alternative Dispute Resolution or ADR is an increasingly popular way of resolving business disputes. It comprises several forms of dispute resolution, including mediation, arbitration and expert determination.

Our dispute resolution team has wide experience with ADR and will be able to advise you of the most advantageous method for your case.

ADR offers many benefits, including being a far quicker and more cost-effective way to handle a dispute. Business owners are usually keen to put difficulties behind them so that they can focus on running their organisation. ADR lets you do this.

It is also a much more flexible solution than litigation, allowing you to agree with your opponents an outcome that is tailored to suit the situation but that a court might not be able to order, for example including non-monetary issues in the agreement.

Sitting down with a mediator may also allow you to save a beneficial commercial relationship that might be destroyed if you went to court.

By choosing mediation, you also have the certainty that you will not have an unwelcome result imposed on you, which is a risk with court action. In mediation, the final agreement will be one that both you and your opponents have agreed upon.

You are still entitled to have legal representation at ADR, and this can help ensure you are clear about the important parts of your case and that you present the right and most persuasive evidence.

Some commercial disputes will inevitably reach court. Our litigation team is outstanding and we have an excellent track record of success at both high court and appeal court level. We have a good understanding of the strengths of a case and know how to press them hard to achieve the right result.

If you do decide that litigation is the right route for you, you can be sure that our team will fight hard on your behalf. We will keep you abreast of all developments throughout and ensure that we are always available to discuss your case and answer any questions you may have.
