ADR offers many benefits, including being a far quicker and more cost-effective way to handle a dispute. Business owners are usually keen to put difficulties behind them so that they can focus on running their organisation. ADR lets you do this.
It is also a much more flexible solution than litigation, allowing you to agree with your opponents an outcome that is tailored to suit the situation but that a court might not be able to order, for example including non-monetary issues in the agreement.
Sitting down with a mediator may also allow you to save a beneficial commercial relationship that might be destroyed if you went to court.
By choosing mediation, you also have the certainty that you will not have an unwelcome result imposed on you, which is a risk with court action. In mediation, the final agreement will be one that both you and your opponents have agreed upon.
You are still entitled to have legal representation at ADR, and this can help ensure you are clear about the important parts of your case and that you present the right and most persuasive evidence.
